Our services Lasting Powers of Attorney Both LPAs, for one person or a couple

Both LPAs, for one person or a couple

Most people put both in place at once, and most couples do it together.

What it is

The property and financial affairs LPA and the health and welfare LPA prepared at the same time. For a couple that means four documents, and it is almost always the sensible way to do it, because the two halves of the problem arrive together.

How it works

  • We take one set of instructions covering both documents, so you are not answering the same questions twice.
  • We prepare the forms, arrange signing in the right order, and deal with the certificate provider requirements.
  • We submit the applications to the Office of the Public Guardian and deal with them until registration is complete.
  • The OPG charges its own registration fee for each LPA, currently £92, which is payable in addition to our fee. Exemptions and reductions are available on low incomes and we will tell you if you qualify.
  • Once registered we store the documents free of charge, or send them to you, whichever you prefer.

Where specialist advice matters

  • Couples very often name each other as sole attorney and stop there. If you are in an accident together, or the survivor is the one who loses capacity, that leaves nobody able to act. Replacements matter.
  • The two documents work differently. The financial one can be used while you still have capacity. The welfare one cannot. People are regularly surprised by this after registration.
  • Different attorneys for different roles is common and perfectly sensible. The daughter who is good with money and the son who lives nearby are not always the same person.

Before you act on anything here

This page is general information about how a Both LPAs, for one person or a couple works. It is not advice, and it is not a recommendation that this arrangement is right for you. Two households with almost identical assets can need completely different documents, and getting the structure wrong is usually more expensive than doing nothing at all.

Please take specialist advice on your own circumstances before acting. That is what the free consultation is for. If the honest answer is that you need something simpler, or nothing at all, we will tell you so.
